All content included on atelierdimaria.com, such as images, pictures, documents, drawings, logos, is the property of L’Atelier di Maria. You may not reproduce, publish, distribute, display, modify, or exploit in any way without the prior express written consent of L’Atelier di Maria.

Atelier di Maria may amend or update all or part of the Terms and Conditions of Use at any time. Any changes shall be binding as soon as they are published on the web site. If you do not agree with to all or part of the atelierdimaria.com’s Terms and Conditions of Use, please do not use our web site.

TERMS AND CONDITIONS OF SALES

1.Commercial Policy

L’Atelier di Maria offers products for sale on atelierdimaria.com and its e-commerce services are available exclusively to end consumers.

By end consumers, we intend any individual who is acting for personal purposes, which should in no way be connected to any trade, business or professional activity.

L’Atelier di Maria reserves the right not to process orders received from users who are not end consumers and any order which does not comply with Atelier di Maria Commercial Policy.

The Terms and Conditions of Sale regulate exclusively the offer, transmission and acceptance of purchase orders relating to products on atelierdimaria.com between the user of atelierdimaria.com and L’Atelier di Maria.

The terms and conditions of use do not regulate the supply of services or the sale of products performed by third parties that are on atelierdimaria.com through links, banners or other hypertext links. We recommend that you verify the third party’s terms and conditions before sending orders and purchasing products and services form those third parties. Because L’Atelier di Maria shall under no circumstance be deemed liable for the supply of services provided by third parties or for the execution of the e-commerce transactions between the users of atelierdimaria.com and third parties.

Atelier di Maria uses English as the language for the purchase of products through our website atelierdimaria.com

On atletierdimaria.com we offer first quality products that have been made by L’Atelier di Maria or thoroughly selected by L’Atelier di Maria.

The main characteristics of each product are shown on each product form at atelierdimaria.com. The images and colors of the products offered, may not accurately correspond to the real garments due to the internet connection and monitored used.

2.How to execute a contract with the vendor

To place an order for the purchase of a product or products on atelierdimaria.com, you must fill the order form, following the relevant instructions and then submit it electronically to L’Atelier di Maria.

Before submitting the order form, you will be asked to read and accept the Terms and Conditions of Sales and the Returns Policy.

The order form contains a summary of the main characteristics of each product ordered and corresponding unit price (including all applicable fees and taxes), the type of payment that you may use in order to purchase each product, shipping terms for the purchased products, shipping and delivery costs.

An order shall be deemed to have been submitted when L’Atelier di Maria receives your order form electronically and the order information has been verified as correct. The order form will be filed in our data base for the time required to process your order as provided by law.

After the order has been submitted, Atelier di Maria will process you order. Atelier di Maria may not process purchases when there are not sufficient guarantees of solvency, or when orders are incomplete or incorrect, or the products are no longer available. In these cases, you will be informed via e-mail that the purchase has not been executed and the reason for the cancellation of the order. If the order has been submitted and an item has been paid for and is no longer available, L’Atelier di Maria will inform you via e-mail and you will be refund for the amount paid for that item.

Atelier di Maria will only ship products to the country where the order has been placed. L’Atelier di Maria will not process orders from countries to which we cannot ship to.

By submitting an order form, you unconditionally agree and accept the Terms and Conditions of Use as well as the Privacy policy and the Returns policy of atelierdimaria.com. If you do not agree with these Terms and Conditions of Sale, we invite you not to purchase products through atelierdimaria.com

Upon submission of an order form, L’Atelier di Maria will send you a purchase order receipt e-mail containing a summary of the order form, the Terms and Conditions of Sale, and the Return and Refund Policy.
3.Product Price Indication

The prices of the products may be subject to change. Please check the final price of the items before submitting you purchase order.

4.Payment

Payment of the items and relevant cost for shipping and delivery can only be made using PayPal or credit/debit card. To make a payment you will be redirected automatically to the PayPal website, which guarantees the security of online transactions. After the completion of the transaction PayPal will redirect you to atelierdimaria.com.

Atelierdimaria.com reserves the right to process orders only if shipped to the same address that the verified PayPal account is registered with. For credit card payments atelierdimaria.com reserves the right to ship the order only to the Billing Address.

5.Shipping and Delivery

Please refer to the Shipping and Delivery Section for the shipping and delivery procedures information. Please read these sections carefully. As the information provided in these sections forms an integral part of these Terms and Conditions of Sales.

6.Consumer withdrawal right

According to Section 64 of the D.Lgs. n. 206/2005, you have the right to withdraw from the purchase agreement for any reason, without a penalty and without the need to give any explanation.

In order to exercise the withdrawal right, you must give a withdrawal notice to L’Atlelier di Maria within fourteen (14 ) working days from the delivery date, when you received the purchased products. Such withdrawal notice must be sent by e-mail to info@atelierdimaria.com

Once the withdrawal notice is received, you will receive an e-mail with instructions for returning the products and a Return Authorization Form to be enclosed with the purchased items you wish to return.

The purchased items must be returned to L’Atelier di Maria within fourteen (14) days from the date you notify L’Atelier di Maria of the cancellation of the contract, in the same condition in which you received them. The products should not have been used, worn, washed or damage; the identification tag should still be attached to the products with the disposable seal; the products should be returned in their original packaging.

The customer is responsible for paying the shipping charges for any items returned. We strongly advise you using a shipping service with tracking number, as you will be the sole responsible of the delivery until the returned products are received by L’Atelier di Maria. L’Atelier di Maria will not be liable in any case for damages or theft/loss of the products while being shipped from the consumer.

If you cancel the contract within the fourteen (14) days, you need to return the product within the following 14 days from the date of cancellation of the contract. We will process the refund due to you as soon as possible and, in any event within fourteen (14) days of the day of reception of the product in our store.


7.Time and modalities of reimbursement

Once L’Atlier di Maria receives the return items, the items will be evaluated according to the terms and conditions indicated in the article 6. If the return items meet the above conditions, L’Atleier di Maria will send you an e-mail confirming the acceptance of the returned products.

We will process the refund due to you as soon as possible and, in any event within fourteen (14) days of the day of reception of the product in our store. For details regarding product limitations and refund policies, please refer to our “Returns and Refunds” section.

Returns that do not meet the conditions and terms described above, will not be accepted and will be sent back to the customer.

9. Limitations of liability

L’Atelier di Maria shall in no case be held liable for careless, unsuitable or inappropriate use of the products sold. L’Atelier di Maria shall not be held liable for actions by third parties who, acting as independent partners, are involved in payment management and settlement activities, in the goods’ delivery, or in any other operation associated with the execution of contracts concluded via this website.

10. Governing Law

The Terms and Conditions of Sale are governed by Italian law. By the Italian legislative decree no. 206 of 6 September 2005 on the consumer code “Consumer rights in contracts”, with specific reference to the legislation on distance contracts. And by the Italian legislative decree no. 70 of 9 April 2003 on certain aspects concerning e-commerce.
